Terms of Service

Platform scope: MuseNest is a digital content membership platform. All payments, messages, tips, custom requests, and subscriptions are for digital content and virtual interactions only. Nothing on this platform may be used to arrange, negotiate, advertise, or facilitate in-person services of any kind.

These Terms of Service ("Terms") govern your access to and use of the MuseNest platform, operated by Phoenix Consulting Group, LLC ("MuseNest," "we," "us," or "our"). By creating an account or using any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1.Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account, access subscriber content, or purchase any digital content on MuseNest. By registering, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts and remove access where we have reason to believe this requirement has not been met.

2.Accounts

You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for any loss or damage arising from your failure to maintain account security.

You may not create accounts using false identities, automated means, or for the purpose of circumventing a prior suspension or ban.

3.Platform Scope — Digital Content Only

MuseNest is a digital creator membership and content access platform. The following activities are strictly prohibited and will result in immediate account termination and, where applicable, referral to law enforcement:

  • Arranging, negotiating, advertising, or paying for in-person services of any kind
  • Using any platform feature (messages, tips, custom requests, payments) as a deposit, hold, or payment toward an offline arrangement
  • Negotiating location handoffs, travel, accommodation, or contact-information exchanges for the purpose of offline meetings
  • Communicating about or facilitating any activity that constitutes prostitution, solicitation, or sex trafficking under applicable law

All custom content requests, paid messages, and tips are for digital deliverables only.

4.Creator Accounts and Obligations

Creators ("models") who publish content on MuseNest agree to the following:

  • Age and consent documentation: You must provide accurate release forms and government-issued identification for every person depicted in your content, as required by 18 U.S.C. § 2257. Content may not be published until release documentation is reviewed and approved by MuseNest's compliance team.
  • Content standards: All content must comply with the Creator Content Policy. Content depicting minors, non-consenting individuals, or illegal acts is absolutely prohibited and will be reported to the appropriate authorities.
  • Accurate representations: Descriptions, previews, and titles must accurately represent the content. Misleading or fraudulent descriptions are prohibited.
  • Tax obligations: You are responsible for reporting and paying all taxes applicable to your earnings. MuseNest may collect tax documentation (W-9 or W-8 equivalent) as required by law and will issue required tax forms to qualifying earners.

5.Fan (Subscriber) Accounts and Obligations

As a fan or subscriber, you agree to:

  • Use content accessed through MuseNest solely for personal, non-commercial viewing
  • Not redistribute, screen-record, screenshot, download, or otherwise copy any gated content for redistribution, public sharing, or commercial use
  • Not reverse-engineer, scrape, or harvest the platform or its content
  • Not attempt to circumvent access controls, paywalls, or content restrictions

6.Subscriptions and Payments

Fan memberships are billed on a recurring basis according to the subscription tier you select. Billing is handled by MuseNest's payment processor. MuseNest retains a platform revenue share; the remainder is the creator's net earnings. Your card statement will show MUSENEST as the merchant descriptor.

Renewals: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

One-time purchases (PPV content unlocks, tips, custom content) are charged at the time of purchase and are non-refundable unless required by applicable law or granted at MuseNest's discretion.

Creator SaaS billing (MuseNest platform subscriptions for creators) is handled separately via Stripe and is governed by separate billing terms provided at registration.

7.Cancellation and Refunds

You may cancel your fan subscription at any time from your account page. Cancellation takes effect at the end of the current billing period; you retain access to gated content until then. No partial-period refunds are issued on cancellation.

Refunds for completed subscription charges are issued at MuseNest's discretion, except where required by applicable consumer protection law. If you believe you were charged in error, contact [email protected] within 30 days of the charge.

Fraudulent chargebacks may result in account suspension and recovery of associated platform costs.

8.Intellectual Property

Creators retain all intellectual property rights in the content they upload. By publishing on MuseNest, creators grant MuseNest a limited, non-exclusive license to host, display, deliver, and technically process their content solely for the purpose of operating the platform and providing the service to subscribers.

MuseNest's platform software, brand assets, and interface design are proprietary. You may not copy, reproduce, or create derivative works from any part of the MuseNest platform.

9.DMCA and Content Removal

MuseNest respects intellectual property rights. If you believe content on the platform infringes your copyright, submit a DMCA takedown notice to [email protected] with: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the platform; (c) your contact information; (d) a statement of good faith belief; and (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf.

10.18 U.S.C. § 2257 Compliance

All content on MuseNest depicting actual or simulated sexually explicit conduct complies with the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. § 75. The Custodian of Records is Phoenix Consulting Group, LLC, located at the address in our 2257 Compliance Notice.

11.Prohibited Content

The following content is absolutely prohibited on MuseNest and will be immediately removed and reported to the National Center for Missing and Exploited Children (NCMEC) and/or law enforcement:

  • Any content depicting a minor in a sexual context
  • Non-consensual intimate imagery ("revenge porn")
  • Content that promotes, depicts, or facilitates violence, human trafficking, or exploitation
  • Content that constitutes illegal material under applicable federal or state law

12.Termination and Suspension

We reserve the right to suspend or terminate any account at any time for violation of these Terms, the Content Policy, applicable law, or for any conduct that we determine is harmful to the platform, its users, or the public. Upon termination, your right to access the platform immediately ceases. We are not liable for any loss resulting from termination.

You may close your account at any time from your account settings. Account deletion anonymizes personal fields but does not remove payment records or audit logs, which are retained as required by law.

13.Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or harmful components.

14.Limitation of Liability

To the fullest extent permitted by applicable law, Phoenix Consulting Group, LLC and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the platform, even if advised of the possibility of such damages.

Our total cumulative liability for any claim arising under or related to these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $100 USD.

15.Indemnification

You agree to indemnify, defend, and hold harmless Phoenix Consulting Group, LLC and its officers, employees, agents, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your content, or your use of the platform.

16.Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Denver, Colorado, and you consent to personal jurisdiction in those courts.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect intellectual property or confidential information.

17.Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or prominent in-platform notice at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms. The current version is always available at musenest.net/legal/terms.
